I hope folks read the story and note that the movement toward the waist band is consistent with reaching for a weapon. I can only imagine getting a call to a hotel with claims that a guy is pointing a gun out the window (who in their right mind does that?) and being on edge.
That said, cops need to be trained to see a gun before firing not just to react to a movement that could be a lot of things like trying to pull up baggy gym shorts.
As the investigator noted, there was nothing to prevent the cops from simply handcuffing the guy.
As for the part about the ex-cop getting his job back...you have to be kidding me, he made a pretty poor judgment call that cost a guy his life.
My guess is that the civil suit will be successful.
Why didn't he just tell him to lay face down with his hands behind his back? Why crawl? Any crawling will result in movement and movements can be misinterpreted, as in this case.
