Too late for Nike. They cannot hide that they will try to sucker athletes into signing short term contracts without reduction clauses, and then try to force them to sign long term contracts after that include onerous reductions.
Athletes beware. Nike contracts are not what Nike pretends they are.
This was the right move
They still took a hit publicity wise but it would have been worse if they carried through, especially if it was in their favor, the public would have been in uproar
Kudos to Nike for being the bigger man and letting it go.

Wrong. No kudos to Nike of any kind. They knew they would lose which is why the judge let them think about it for a week. Nike would have been full forward if they thought they could crush Berian. Fact!

I would bet that they made the point they wanted to make and feel like they can let it go now.

The only point Nike made is to let every athlete know they Nike will include significant reduction clauses in their contracts.

I think they realized
a) likely would lose and that would be REAL bad. The questioning of the judge yesterday made it seem like he was skeptical that they matched.
b) even if they win, they come across as jerks for making a former McDonald's worker. wear their stuff.
So basically they lose either way. The more I think about the more I realize b) might be the worse for them as the story would go on and on for 3 years.

Nor did Nike want any of its people to be deposed. That might have gotten a little too interesting.

I think it was negatively affecting their current recruiting college graduates. Adidas, New Balance, Asics, Brook, and Hoka were stealing some of their prize recruits because of the negative image Nike has with athlete treatment.
