I have the same thoughts, but with spilling coffee on my lap today at a diner.
Should I sue?
Was the coffee superheated (yes that is a thermodynamic term) enough to create 3rd burns in seconds in an attempt to keep coffee hot for hours prior to sale and require multiple operations to your genitals despite repeated reports that the coffee was far too hot for normal consumption and the lids kept falling off and scalding customers in their cars?
If so, you might be one of the few large cases to permit treble damages. McDonald's deserved a slap on the wrist for their conduct (even before the damages were substantially reduced in that case it didn't hurt mcd shares), much like ford and the pinto.
As for the concrete guy, the fact that you aren't licensed doesn't bar your recovery, but will make it more difficult and as others said a lawyer probably won't pick it up. If you did everything by the book and it still exploded it is the company's fault not yours so it would be worth calling the company or writing ... they may give a small amount if you agree not to sue, but that is your best shot.
