I think people gravitate to the idea that he has seriously lawyered up because it would help explain the lack of a DQ. But there are other possible explanations like simple incompetence, a misunderstanding of defamation law, a public relations error about how to best protect the name of the event and the sponsors, underestimating the potential backlash, you name it.
But no, I have not heard from a lawyer.
When this whole thing started Mike told the press that he had read many of the comments on runner forums and had contacted an attorney about it.
Here is the exact quote:

Just that would be enough get them worried about losing thousands of dollars of charity money to some nobody who finished 114th place.
I'm sure some of the people on here were simply waiting to here if they DQ'd and when the decision came they just lost interest. People have speculated that Rossi threatened to sue. But I doubt that is the case.
But his many alter egos have come on here and been posting that we should get a life and move on, and have suggested that some posters have been silenced. It's all just a ploy of his to get people to drop it.
He still thinks he can control the damage to his reputation, business, and most likely his marriage.
