So I am talking to my neighbor on their porch, standing on the steps, while she was sitting with her pitt-bull mix (leashed and held), and the dog starts barking and getting excited. I figure the dog wants to come say hello, as these guys take very good care of their dogs, so I ignore the dog and keep talking. All the sudden the dog leaps at me over the porch gate so forcefully that the owner can't restrain the dog. The dog tags me and bites a chunk of my R cheek. Owner screams and pulls the dog back over the gate. So I am stunned, wondering wtf happened. Touch my cheek which produces the oh-$hit bloody hand, and I start dripping blood on my shirt. Owner freaks and starts yelling OMG!! and RUOK!! but is careful not to apologize, surely out of fear that I am going to sue or ask that the dog be put down. She then blurts the classic, "She has never done this before!" and then the kicker, "You must have gotten into her space!" Rather than get pissed that she has the cajones to suggest that I am in any way at fault, or that the dog is not 100% at fault for tearing into my face unprovoked. All I could think of was, how pathetic that this person I know to be really nice, is being a b!tch because she assumes I am going to sue her. Long story short, I get the dogs vax records, get stitches and am fine. My face is healing with surprisingly little scar. But I have decided not to pursue any action, other than having a sit-down talk with the owner about the serious liability her dog is to her and the neighborhood, because I think it's so pathetic that Americans expect to sue or be sued every time something bad happens. I did have the talk with her, and she is enrolling the dog in some intense obedience training. (She spares no expense with this dog and seems to love it like a child.) But I also feel I might be setting up some poor guy or child down the road to be maimed by this dog if I don't report. |

Ha, I wish I was making this up. Been wearing a giant f-ing bandaid on my face for the past week and half. Today's the first day, I am walking around with nothing covering the laceration (had steri-strips for 3-4days). Only one spot of scab left... |

Going into a dogs territory and getting close to an owner without direct contact with the dog no matter what the breed is a hit or miss situation. Thanks for not suing or trying to get the dog put down. People need to realize that most dogs are super protective of their owners and even the littlest furball dog can get aggressive. She sounds like a responsible owner who isn't letting the dog roam free around the neighborhood. I've been bitten by a friends dog at a house party, got face to face with him petting and he nipped the top of my head. I was in his space and home and he was stressed from all the people and noise. |

I'm really glad you decided not to sue, and you're right, Americans sue over EVERYTHING, but I was not pleased with the owner of the dog suggesting you got in the dog's space. Also, it's sad to see it was a pit bull (mix) considering the breed already has a bed rep. I had a dog who had done the same thing to my aunt (needed stitches in her leg), and of course my mom brought him back to the shelter right away. It was a really upsetting time for all of us, so I somewhat symphathize (sp?) with the owner for not wanting her dog to be taken away. But she really has to consider that the dog has the potential to bite somebody else. I hope that this "intense obedience training" works, and I hope you heal soon. |

This thread makes me wonder what I would do if my dog did something like this (I really don't think she would - greatest dog ever - but I wonder if I won't be as lucky with the dog i get after this one dies). I sure as hell wouldn't sit with it outside if I knew it might attack strangers. |

It sounds like you have, at least, a friendly relationship with your neighbor so good for you for not suing. Did she pay your medical bills? I think I would have insist on that at least. Especially after she blamed you for the incident. |

That is definitely what you are doing, possibly someone in your own family. DO NOT DELAY. Talk to the City Attorney, fill out a report with them, report the dog to animal control. Forget the nicey nicey vibes with the neighbor who obviously doesn't care what happens to anyone. |

You sue for damages cost you money. You can ask her to pay for the medical costs that it cost you; it sounds like she'd pay it. Other than that, do you make a living with your face, like a model? Is the harm going to be forever? If not to either, than you can't really sue for much other than the medical costs, any time off for work if there was any. You can't sue for what might happen to someone else down the road in the future. Only how it might affect you in the future. You've already admitted that it's only a small scar. |

Well, I have good insurance so I paid nothing for my medical care. It is possible that my insurance company will come asking questions to see if they can go after her. Any dog can bite you, not matter how small. I've had all manner of dogs come after me while running. Never been bitten because I lunge and yell at them. I am sure there are plenty of lawyers who would love to trump up a case against this lady and her dog. Pain, suffering, blah, blah, blah... |
