I have two sons that run for their perspective schools. My sons normally do a long run of 4-6 miles in the evening. My sons run on the road or the grass next to the road when possible. I always follow my sons on their runs in my car with my hazards on because I don't trust the drivers coming up behind them. On yesterday evening my sons and I were doing our usual routine when I noticed a couple of youngsters walking to Pitts on a chain. I immediately told my sons to swing outward to put as much distance possible between them and the dogs. My sons did just that. After my son's passed the dogs and crossed over closer to the side of the road one of the Pitts took off after my sons and then the second dog bolted after them also.
I was somewhat startled at first and remembered the dogs were on chains. I just happen to see a glimpse of one of the young men and he was laughing (it all happened so fast). I noticed the dogs were catching up top my sons and the owners had let some slack in the chain. I immediately honked to alert my sons and hopefully to scare the dogs off my sons trail. When my sons looked back and saw what was happening I could see the terror in their eyes. My sons started screaming and scattered two seperate directions. One of the pitts caught up to the youngest son (14) and lunged at him. I didn't know what else to do so I jumped the curve with my vehicle and hit the dog. I slammed on the breaks after hitting the dog so I wouldn't run over my son also. My son was fine but pretty shaken up. My older son (16) got away because the guy holding the other dogs chain choked up on it and took out the slack. The dog had to crawl from underneath my car and it was obvious his back left hip was broken.
The owner's of the dogs actually called the cops on me and wanted me to pay the dog's vet bill. The officer was actually listening to the owner's as they told him I over reacted to their dogs being near my sons and I ran over their dogs. They were lying!!!! I saw them let slack in the chain after my sons ran by....and they were laughing about it! The police officer told the owner they have to be in control of the dog and not just have it on a chain. The dog owners told the officer their dog has just as much right to be on the street as my sons did running on it. The officer took a report and told the young men controlling the dogs it's their responsibility and other than my sons running up to and taunting the dogs they were responsible.Today I got a call from the owners lawyer and now I am being sued for injury to their dog.
My only regret is that I couldn't split my vehicle into two halves and run over the other mutt. Could I really be responsible for what I did monetarily? I just didn't know what else to do. I did not want to see my son lose a piec of his chest or neck.
