1) That's Kentucky, not the real world.

2) The U.S. courts have already opined in favor of anonymous posting.

No. The law states a bath can be taken AT MOST once a year.

The problem is that when one state bans an online activity, it can enforce its law against website operators all over the country as long as someone in the restricting state uses the website for the locally illegal purpose.
This has happened with online gambling. One state outlaws it, has their investigators use gambling websties, and then starts issuing arrest warrants for people in other states who operate those websites.

Even if the Kentucky law is unconstitutiuonal, it will take a long time for the legal process to work that out. In the meantime, Kentucky can cause all sorts of problems for everyone.

no. the same day the law is effective, a lawsuit seeking an injunction preventing enforcement of the law will be filed and immediately granted. there will be no "in the meantime." this law, if enacted, will never, ever be enforced against anyone. this isn't internet gambling; this is a clear constitutional issue.

Whine, whine, whine. I am a Kentuckian, a runner, and I take a bath every day. Being an attorney who practices more or less statewide, I know a bit about the First Amendment and I can tell you this is never going to make it through our legislature. Many Kentuckians enjoy the same vicious anonymous posting you do and would never give it up.

Give it a rest about us and baths. Borrrrinng. Come up with something more creative.

A lawsuit seeking an injunction may be filed the same day the law is passed, but an injunction will not issue that same day. The government of the state will have a right to a hearing. That hearing will not take place the same day the lawsuit is filed. There will be an "in the meantime."

All that is, of course, assuming the law passes. The Kentucky lawyer who says this bill never will become a law is probably right.

How does that work? How do you show "standing?" Would the injunction have to come from a federal district court?

I get that it's a clear 1st amendment issue, but does someone have to be "injured" by the law?

Louisville, KY is just like any other mid-major city in the nation. Podunk USA, KY is just like any other out of the way city in the nation. There are dumb rednecks in every state.

The only difference between KY and the rest of the nation is that we smoke more and eat more.

The law I'm sure is partially due to some teen girl killing herself over some online bullying. The online bullying was done by the mother of another teen because of some boy drama between the mother's kid and this kid her hung herself. Really, it's nothing more than a reason to bring awareness to the issue. The law won't make it past it's initial discussion. It could however start a larger discussion about regulation of the internent...which would be a good thing.
